1. Acceptance of Terms
By accessing or using the Tixmore platform ("Service"), operated by Tixmore LLC, a Wyoming limited liability company ("Tixmore," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. These Terms apply to all users, including event organizers ("Organizers") and ticket purchasers ("Attendees").
2. Description of Service
Tixmore is an event management and ticketing platform that enables Organizers to create event pages, sell tickets, manage registrations, and check in attendees. Attendees can browse events, purchase tickets, and receive e-tickets for entry.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must be at least 16 years old to create an account.
- Organizers who sell paid tickets must be at least 18 years old or the age of majority in their jurisdiction.
4. Event Organizer Terms
4.1 Event Content
Organizers are solely responsible for the accuracy of event information, including titles, descriptions, dates, locations, and ticket details. Tixmore does not verify or endorse any events listed on the platform.
4.2 Pricing
- Free events: No fees are charged by Tixmore.
- Paid events: Tixmore charges a percentage-based service fee per paid ticket sold, with minimum and maximum caps depending on the event currency. Current rates are listed on our pricing page. This fee is deducted from ticket revenue before payout.
- Payment processing fees from third-party payment providers (e.g., Stripe) are separate and apply at standard rates.
4.3 Payouts
Ticket revenue (minus applicable fees) is paid out to Organizers according to the payout schedule of the connected payment provider. Organizers must maintain a valid payment account to receive payouts.
4.4 Event Cancellation
If an Organizer cancels an event, they are responsible for issuing full refunds to all ticket holders. Tixmore may assist with processing refunds but is not liable for the Organizer's refund obligations.
5. Ticket Purchaser Terms
5.1 Purchases
All ticket purchases are made directly between the Attendee and the Organizer. Tixmore acts as a platform facilitating the transaction. By purchasing a ticket, you agree to the event-specific terms set by the Organizer.
5.2 Refunds
Refund policies are set by individual Organizers. Tixmore does not guarantee refunds. If an Organizer offers refunds, they will be processed through the original payment method. Tixmore's per-ticket service fee is non-refundable unless the event is cancelled.
5.3 E-Tickets
Upon successful purchase, e-tickets with QR codes are delivered to the email address provided. Attendees are responsible for presenting valid e-tickets at the event. Tixmore is not responsible for lost, stolen, or shared tickets.
6. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or to promote illegal activities
- Create fraudulent events or sell counterfeit tickets
- Impersonate any person or entity
- Interfere with or disrupt the Service or its infrastructure
- Scrape, crawl, or use automated means to access the Service without permission
- Attempt to gain unauthorized access to other users' accounts
- Upload malicious code or content
- Use the Service to send spam or unsolicited communications
7. Intellectual Property
The Tixmore name, logo, and all related trademarks, service marks, and visual design are the property of Tixmore. You may not use our branding without prior written consent.
Organizers retain ownership of their event content (descriptions, images, etc.) and grant Tixmore a limited license to display and distribute this content as necessary to provide the Service.
8. Limitation of Liability
To the maximum extent permitted by law, Tixmore shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or revenue, arising from your use of the Service.
Tixmore is a platform provider and is not responsible for the actions, content, or conduct of Organizers or Attendees. We are not liable for event cancellations, changes, or the quality of events listed on our platform.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Indemnification
You agree to indemnify and hold harmless Tixmore and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Termination
We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to Tixmore, other users, or third parties. You may delete your account at any time by contacting us.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating this page and the "Last updated" date. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
